Finalized Rule May Impact Lincoln Nautilus For 2027 Model Year

For a few months now, the U.S. Commerce Department has been mulling the idea of prohibiting key Chinese software and hardware in connected vehicles on American roads, which would effectively ban all of those types of vehicles from the U.S. – including the Lincoln Nautilus, which is produced solely in China at the Changan Ford Hangzhou Assembly plant and imported into the U.S. The agency planned to finalize that rule this week, and now, that’s precisely what has happened – though some questions still remain.

As Ford Authority reported yesterday, the U.S. Department of Commerce was considering excluding vehicles with Chinese software that was developed before these new rules take effect, so long as it’s not being maintained by a Chinese firm, which would presumably include the Lincoln Nautilus. Whether or not that will be the case isn’t currently clear, but what we do know is that the final rule places a ban on software and hardware stemming not only from China, but also Russia.

For now, the final rule applies only to passenger vehicles (defined as those under 10,001 pounds), but the U.S. Department of Commerce plans to issue a separate rule addressing the technologies present in connected commercial vehicles – including in trucks and buses – in the near future. The final passenger vehicle rule prohibits the import of VCS hardware or connected vehicles containing such hardware, and the import and sale of vehicles containing VCS or ADS software, with a “sufficient nexus” to China or Russia. VCS is defined as the set of systems that allow the vehicle to communicate externally, including telematics control units, Bluetooth, cellular, satellite, and Wi-Fi modules. ADS includes the components that collectively allow a highly autonomous vehicle to operate without a driver.

The rule also prohibits manufacturers with a sufficient nexus to China or Russia from selling new connected vehicles that incorporate VCS hardware or software or ADS software in the United States, even if the vehicle was made in the United States. The software-related prohibitions will take effect for the 2027 model year, followed by hardware-related prohibitions for the 2030 model year, or on January 1st, 2029, for units without a model year. Prohibitions on the sale of connected vehicles by manufacturers with a sufficient nexus to China or Russia, even if manufactured in the United States, will take effect for the 2027 model year.
