Back in March 2022, the Environmental Protection Agency (EPA) reinstated the right for California to set its own emissions standards, not too terribly long after former (and future) President Donald Trump took action to strip it beforehand. This past December, the Environmental Protection Agency (EPA) granted the state that right, paving the way for California to enact its plan to ban the sale of pure ICE vehicles by 2035. Now, however, this back and forth continues, as the U.S. Senate has voted to revoke California’s ability to set an EV mandate and its own independent emissions rules.
According to NPR, the Senate voted 51 to 44 to overturn California’s EPA waiver, though that vote doesn’t yet pertain to two other waivers enabling the state to mandate zero-emission heavy trucks and set stricter emissions standards for new diesel trucks. Lawmakers are leaning on what’s known as the Congressional Review Act (CRA) to execute this move, though there have been plenty of questions regarding whether or not they have a legal right to do so.
Ford has largely backed California’s right to set its own emissions standards and even create an EV mandate of sorts, with CEO Jim Farley expressing doubts that such laws would actually work. However, the Ford-backed lobby group known as the Alliance for Automotive Innovation (AAI) has thus far supported the current administration’s efforts to roll back EV mandates and emissions standards in general, calling them untenable and unrealistic.
AAI recently sent a letter to Congress asking it to repeal the waiver granted to California by the EPA, which would impact 11 other states that have adopted its stricter emissions rules. It claims that those mandates would mean that automakers will be “forced to substantially reduce the number of overall vehicles for sale to inflate their proportion of electric vehicles sales.” Thus far, a few of those states have opted to delay the implementation of their EV mandate, which has drawn the praise from AAI as well.

California has been stealing tax payer dollars for their Green New Scam for years. They are out of touch with reality. They believe if they keep gaslighting the public they’ll eventually believe in their upside down universe of bad ideas. One car of today pollutes less than 90 cars of vehicles produced prior to 1989. The California grid can not support their EV agenda, but yet they keep pushing. If EV’s are so great, let them compete on their own merits without tax payer funding. If California had focused on forest management they could have stopped the wildfires that erased eighteen years of pollution control. It’s all fine and good to have pie in the sky ideas, but many parts of the world are not going to be driving EV’s. Try going to Asia, South America or the Philippines, they’re riding two stroke scooters. We need to get real and let the market dictate the best ideas. Also, the climate on earth has always changed and evolved, and all your altruistic ideas and virtue signaling is not going to change it.
